The National Labor Relations Board (NLRB) has proposed the following changes to representation elections:

  1. Eliminate Blocking Charges…Under the proposal the NLRB will no longer postpone a representation election based on unproven unfair labor practice charges; 2. a modification to the present Voluntary Recognition Bar .. the proposal reinstates the 2007 rule that after an employer voluntarily recognoizes a union (no election being held) the employees can petition the NLRB for an election and ;3 Construction industry pre-hire agreements  …under the new rule ,if adopted , the NLRB will require actual evidence of employee majority support before the pre-hire agreement has status as a collective bargaining agreement
